The times between filings:

If you filed a bankruptcy in the past, a certain amount of time must go by before you are eligible for another bankruptcy discharge. In some situations, such as some Chapter 13 cases for foreclosures or tax situations, you may not need a discharge –you just need the protection of the Court while you pay the creditors back.

Chapter 7 followed by a Chapter 7: 8 years.

Chapter 13 followed by a Chapter 7: 6 years. (Unless you paid all of your unsecured creditors back in the Chapter 13, then there is no waiting period.)

Chapter 7 followed by a Chapter 13: 4 years.

Chapter 13 followed by a Chapter 13: 2 years. (Unless you paid all of your unsecured creditors back in the first Chapter 13, then there is no waiting period.)
